Terms of Service

⚠ Important — Not medical advice. Biomena Health is a wellness and coaching platform, not a medical service. Nothing in the Service is intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional before making health decisions or starting new protocols.
1. Acceptance of these Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Biomena Health ("Biomena," "we," "us," or "our") governing your access to and use of the Biomena website at biomenahealth.com and our mobile applications (collectively, the "Service").
By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
- You must be at least 18 years old to use the Service (or 16 with verifiable parental consent where permitted by law).
- You must have the legal capacity to enter into a binding contract.
- You must not be barred from using the Service under the laws of your jurisdiction.
3. The Service — what Biomena is and isn't
3.1 What we provide
Biomena is a longevity, wellness, and coaching platform built around the Biomena Method™. It includes assessments, tracking, plans, herbal-medicine information, wearable-device integrations, and AI-assisted and human-assisted coaching, along with subscription tiers that unlock various levels of access.
3.2 What we are NOT
Biomena is not a medical service. We do not provide medical diagnosis, treatment, medication management, mental-health therapy, emergency care, or any regulated healthcare service. Our coaches, whether AI or human, are not your doctor.
- Do not rely on Biomena for medical decisions.
- Do not delay seeking medical advice because of information from the Service.
- If you think you may have a medical emergency, call your local emergency number (e.g., 999 UK / 911 US / 112 EU) immediately.
- Consult your physician before beginning any new supplement, herbal protocol, fasting regimen, or exercise programme, especially if you are pregnant, nursing, taking medications, or have a chronic condition.
4. Your account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Provide accurate, complete, and current information. Update it if it changes.
- Notify us immediately at security@biomenahealth.com of any unauthorised use of your account.
- You may not share your account credentials, transfer your account, or create more than one account per person without our prior written consent.
5. Subscriptions, billing & free trials
5.1 Subscription plans
Biomena offers several subscription tiers (Free, Premium, Pro, Elite, and various Coach plans). Feature availability and pricing are shown in the app or on the pricing page and may change with notice as described in Section 12.
5.2 Free trials
Where a free trial is offered, we will disclose the length of the trial before you sign up. At the end of the trial, your subscription will automatically convert to a paid subscription at the then-current price unless you cancel before the trial ends. You can cancel at any time in the app's subscription settings.
5.3 Recurring billing
Paid subscriptions automatically renew at the end of each billing period (monthly or annually) using the payment method on file. You authorise us and our payment processor (Stripe, Inc.) to charge that payment method on each renewal.
5.4 Price changes
We may change subscription prices. If we do, we will give you at least 30 days' notice by email. Continued use after the effective date constitutes acceptance of the new price. If you don't agree, you may cancel before the change takes effect.
5.5 Cancellation
You may cancel at any time from the subscription settings within the app or by emailing billing@biomenahealth.com. Cancellation takes effect at the end of the current billing period; you retain access until then.
5.6 Refunds
- EU / UK consumers: you have a 14-day right of withdrawal under the Consumer Rights Directive / Consumer Contracts Regulations, unless you have already begun receiving digital services and expressly waived that right when subscribing.
- Outside EU/UK: subscriptions are generally non-refundable once the billing period has begun, but we may issue refunds at our discretion for genuine service failures. Contact billing@biomenahealth.com.
- App Store and Google Play purchases are subject to those stores' refund policies; contact them directly.
6. Coaching services
Some subscription tiers include access to human coaches. Coaches provide general wellness guidance and are not licensed medical professionals unless explicitly stated. Coaches:
- Do not diagnose or treat medical conditions.
- Do not provide mental-health therapy or crisis counselling.
- Do not prescribe medications, supplements, or protocols.
- May share evidence-informed information and help you set goals and build habits.

7. Wearable devices and third-party data
- Biomena integrates with wearable devices (e.g., Withings, Oura, WHOOP, Apple HealthKit, Google Health Connect) at your explicit request.
- The accuracy of imported data depends on the third-party device or platform. We do not guarantee its accuracy.
- You may disconnect any integration at any time from within the app.
- Your use of a third-party device or app is governed by that provider's own terms and privacy policy.
8. AI-generated content
- The Service includes AI-generated insights, plans, summaries, and chat responses.
- AI outputs are advisory and can be inaccurate, incomplete, or out of date. Always verify important information with a qualified professional.
- Do not use AI outputs to self-diagnose or treat any condition.
- We do not permit our AI providers to use your data to train their models.
9. Herbal information and supplements
- The Biomena Herbal Compass and related content are educational. They are not medical advice and are not endorsements of specific products.
- Herbs and supplements can interact with medications and are not risk-free. Consult your physician before use, especially if pregnant, nursing, or taking prescription medication.
- Biomena does not sell or ship herbal products. Where we link to third-party products, we may earn an affiliate commission. This does not affect what we recommend or how.
10. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Scrape, crawl, or use automated systems to access the Service.
- Reverse-engineer, decompile, or otherwise attempt to extract source code.
- Interfere with the Service or attempt to breach its security.
- Upload content that infringes third-party rights, is defamatory, or is otherwise unlawful.
- Use the Service to provide competing services or train competing AI models.
- Impersonate any person or misrepresent your identity.
11. Intellectual property
- The Service, including all software, content, designs, "Biomena Method™," "Herbal Compass™," "Human Profile™," "Capability Index™," logos, and other trademarks, is owned by Biomena or its licensors and protected by copyright, trademark, and other laws.
- We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.
- You retain ownership of the content you submit ("Your Content"). By submitting Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and process it as needed to provide the Service to you.
- We may use anonymised and aggregated data (which cannot be linked back to you) to improve the Service and for research.
12. Changes to the Service or these Terms
We may modify or discontinue features of the Service at any time. If we make material changes to these Terms, we will notify you at least 14 days before they take effect by email or through the app. Continued use after the effective date constitutes acceptance of the updated Terms.
13. Suspension and termination
- You may terminate your account at any time from account settings or by emailing hello@biomenahealth.com.
- We may suspend or terminate your access if you violate these Terms, if your account is inactive for an extended period, or if required by law.
- On termination, your right to use the Service ends immediately, but Sections 8, 11, 14, 15, 16, and 18 survive termination.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Biomena disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and continuous availability.
We do not warrant that:
- The Service will meet your specific requirements or produce specific health outcomes.
- The Service will be uninterrupted, timely, secure, or error-free.
- Information within the Service is accurate, complete, or reliable.
- Any imported wearable data is accurate.
15. Limitation of liability
To the fullest extent permitted by applicable law:
- Biomena will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, arising out of or related to the Service.
- Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
16. Indemnification
You agree to defend, indemnify, and hold harmless Biomena, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.
17. Third-party links and services
The Service may contain links to third-party websites, products, or services. We do not control and are not responsible for those third parties. Your use of them is at your own risk and subject to their terms.
18. Governing law and dispute resolution
- These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles.
- Disputes will be resolved exclusively in the courts of England and Wales, unless mandatory local consumer-protection law provides otherwise.
- Nothing in this section limits your rights under any mandatory consumer-protection laws that apply to you.
19. Miscellaneous
- Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Biomena regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
- No waiver. Our failure to enforce any right does not waive that right.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms freely.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
